On the afternoon of 27th September, Mr. Wang Zhengyang, Senior Partner of Junzejun (Shanghai) Law Firm, and Mr. Masahiko Goto, Senior Advisor, gave a lecture on "Responding to and Preventing Fraudulent Acts by Employees Against the Company's Interests" in Chinese and Japanese respectively, to assist enterprises in responding to and preventing the risk of fraud and promoting the establishment of anti-fraud and compliance mechanisms of the enterprises. More than 30 representatives of Chinese and Japanese enterprises participated in the event.

 

 

Mr Wang Zhengyang and Mr Goto Masahiko focused on three aspects: types of fraudulent acts by employees against the company's interests, how the company can effectively combat fraudulent acts, and how to prevent fraud effectively. They also analyzed the crimes of employee infringement of company interests, such as embezzlement, misappropriation of funds, acceptance of bribes by a non-state functionary, and infringing upon trade secrets through case studies. They interpreted them in terms of the legal provisions and the common situations of the relevant crimes in practice.

 

 

Regarding the prevention of and response to the risk of employee fraud, they proposed that enterprises should investigate and deal with corporate fraud cases promptly to avoid systematic fraud between different departments and coordinate fraud within the same department. While strengthening the construction of the internal control system, improving the channels for anti-fraud detection and continuous improvement of the compliance work, and strengthening the roles of professional supervisors and attorneys in the company's anti-fraud investigations and handling. They also emphasized that while strengthening compliance risk identification and assessment and response, enterprises should strengthen the construction of corporate integrity culture, compliance management system, and compliance culture to prevent the occurrence of fraud effectively, help enterprises avoid and reduce the risk of “entity crime”, and help enterprises to develop steadily.

 

 

After the lecture, the participants communicated with Junzejun lawyers on relevant legal issues. Junzejun lawyers will continue to carry out training on relevant topics to help enterprises prevent and resolve risks in the process of anti-fraud and compliance creation.
