Mr. Zhao Yu is a doctor of law from China University of Political Science and Law. The main practice areas of Mr. Zhao are civil and commercial litigation & arbitration, corporation's legal affair and investment & financing. Mr. Zhao has particularly experience in the areas of dispute resolution regarding commercial contracts, corporation, equity, finance, trust, investment & financing and private equity, real estate, construction, capital market, and successfully handled a large number of pioneering and influential major cases.

 

Zhao Yu is a dispute resolution lawyer with profound theoretical basis and very high litigation practical ability. He has successfully handled a large number of influential and pioneering cases in the past practice, including winning one of the first VAM disputes in China; Successfully represented a rare "short-selling misrepresentation" case in China, which became a benchmark case in the Chinese capital market; representing a major benchmark case in the International Commercial Court of the Supreme People's Court of China; and successfully representing a rare dissolution of a large joint stock company involving thousands of shareholders and billions of RMB in assets. Clients served by Zhao Yu include Huawei, Tencent, Construction Bank, China Merchants Bank, Bank of Shanghai, COFCO, Aerospace Science and Industry, Hong Kong Chuang's Group, PILGRIM Asia, Ubiquiti Networks, Bitmain Technologies Limited, CoStone Capital, SINO LIFE ASSET and other well-known companies. Publication

  • Authored "From the Perspective of Financial Institutions to See the "High Winds and Rapid Waves" of Intellectual Property Pledge Financing", published in Shenzhen Lawyer, Issue 1, 2021, which was honored as an excellent article in Shenzhen Lawyer.
  • Co-authored the paper “Typological Analysis on PE Valuation Adjustment Mechanism in China and Relevant Litigation Case Studies”, which has been published in Chinese Equity Investment and Corporate Governance (University of International Business and Economics Press, September 2014).
  • Co-authored the paper “Research on the Legal Issues regarding the Disputes and Arbitration of Private Lending”, which has been published by Shenzhen Arbitration Commission in the issue of Arbitration Discovery, No.133, 2013.
 

Recent case highlights 

  • Case 1 - Represented a Cayman Islands fund in a major cross-border insurance arbitration dispute against Insurance Co. The case was heard by the China International Economic and Trade Arbitration Commission and involved over $30 million. This insurance dispute involved a rare combination of financial and professional insurance in the insurance law, and there was a gap in the application of the law, which was an extremely complex and innovative case in the insurance field. The case involved Chinese and Cayman law, and the trial was attended by more than a dozen lawyers and expert witnesses from China, Hong Kong, Cayman, Singapore, England and Ireland. This case is also a major and typical cross-border arbitration case accepted by CIETAC.
  • Case 2 - Represented a holding group in a equity dispute. Due to the huge controversy and great typical significance, this case was raised to the China International Commercial Court for trial, and was heard by a five-member panel. This case involved extremely complex issues, including Identification of shareholding transfer, malicious prosecution in the commercial disputes and so on. As for these issues, there were considerable legal gaps in the criteria of recognition and the nature of legal relationship. This case was highly controversial, highly adversarial, extremely difficult to represent, which makes it with great typical significance. The China International Commercial Court stated in its decision on raising this case that "this case is an international commercial case of first instance with great impact and typical significance, which is of great concern to all sectors of society, and the interests involved in the dispute are enormous, so it is appropriate for the China International Commercial Court to hear it". The China International Commercial Court very rarely formed a five-member panel to hear the case. The Supreme Court invited media reporters and the National People’s Congress deputies and legal experts to attend the trial, which was also broadcasted live online and watched by nearly 60,000 people.
  • Case 3 - Representing the actual controller of a well-known technology company in some important cases in a series of corporate control disputes with other shareholders. The valuation of the target company exceeds tens of billions RMB. The case is extremely complicated and related to huge interests, complex domestic and foreign ownership structure arrangements and disputes. The related parties have successfully reached a settlement. Zhao Yu played an important role in the series cases and led his team handled the important part of cases in Shenzhen.
Working Experience and Education Background

Mr. Zhao joined JunZeJun Law Offices in 2012. Before that, Mr. Zhao worked in King & Wood Mallesons(Y2010-Y2012)and the headquarters of Shenzhen Development Bank (now is Ping An Bank) in Y2010.

 

Mr. Zhao graduated from China University of Political science and Law with Bachelor of Law degree, Master of Law degree and Doctoral Law degree.
